LATE FILING HINDERS IPOB'S NNADI KANU'S MOTION FOR URGENT MEDICAL ATTENTION
A motion filed by detained pro-Biafra agitator, NNAMDI KANU, seeking an order of a vacation court for an emergency medical attention at the National Hospital in Abuja has been returned to the Chief Judge of the Federal High Court for reassignment due to late filing and the end of court vacation.
Justice MUSA LIMAN of the Federal High Court sitting in Abuja made the decision based on an application by KANU’s lawyer, UCHENNA NJOKU; Senior Advocate of Nigeria, as the annual vacation by judges came to an end today, September 15.
Addressing the matter at the resumed hearing of the case, Justice LIMAN noted that there was no time for the vacation court to decide KANU’s motion, which he identified as an important matter as it concerns his health.
The judge noted that more that thirty cases were listed for consideration by the registrar, but later pruned down to six, since the court would be unable to take all.
Justice LIMAN referred to Section 46(8) of the FHC Rules, which provides that any case that could not be completed within the vacation period would have to be sent back to the Chief Judge for reassignment.
The prosecution counsel of the Department of State Services, led by ADEGBOYEGA AWOMOLO, SAN, did not oppose the application, saying that in case management, the court had the overriding decision on whether a case should go on or not.
